Japan’s Toshiba has filed a suit against Imation and several other manufacturers and distributors of recordable DVD media, claiming that they are infringing its DVD patents.
The lawsuit filed in the United States District Court for the Western District of Wisconsin, says that Imation and other companies do not have license agreements with Toshiba or the DVD6C Licensing Group covering recordable DVD media, and have engaged in the importation and sale of recordable DVD media without permission.
Toshiba seeks damages for past infringement and requests the court to bar the sale, manufacture and importation into the US of recordable DVD media by the companies named in the lawsuit.
Toshiba said that the recordable DVD media is sold in the US under the Imation and Memorex brand names.
Along with Imation, the other companies on whom the Toshiba has filed a lawsuit are Moser Baer India, CMC Magnetics, Ritek of Taiwan, and Glyphics Media, Hotan, Khypermedia and Advanced Media.
